3. All use of images and metadata (captions, data release, etc.) on this website is subject to the terms of service agreement outlined below.
4. This website uses cookies to recognize users and maintain account settings. These cookies do not transmit personal information but only record technical data such as the user's computer IP address, website access time and date, etc. Disabling cookies may result in some website features not functioning correctly. </aside>

1. "Image" refers to all types of visual content created through optical, electronic, digital, or other means, and includes all metadata, keywords, descriptions, and captions associated with the image. Mentions of images encompass the entirety or a portion thereof.
2. The "Data Usage Agreement (hereinafter referred to as the Agreement)" is a contract provided by the company and includes provisions regarding the scope of permission for image selection, restrictions on access and use of images, and the fees applicable to the provision of services. </aside>

1. Users may only use the data within the scope and for the purposes outlined in the agreement. Users can utilize images only within the explicitly specified limits set in the contract (reproduction, broadcast, transmission to third parties, development, and production of related derivatives) and may use additional images only upon obtaining additional permissions.
2. Images for which usage rights have been acquired as per the contract can be freely edited.
3. If the entity entering into the data usage agreement and the actual user are different, using the images as specified in the contract is permitted. However, it is essential to adhere to the limitations outlined in the contract and agree to the conditions of this agreement. Customers who have entered into the data usage agreement and the actual users are jointly and severally responsible for all usage. In the event of any legal disputes arising from the use of images provided by the customer's company, which is the actual user that did not directly enter into the data usage agreement, the user must protect and indemnify the company from all damages, liabilities, and costs (including reasonable attorney fees and expenses) associated with litigation, claims, or legal proceedings. </aside>

1. The usage of images is strictly limited to the specifications outlined in the contract, including usage, media, time, print quantity, layout, image size, region, and other restrictions. Users cannot use images beyond the allowed scope as indicated on the invoice. To use images beyond the specified scope, users must pay additional service fees in advance and update the contract.
2. Images provided by Modern Times cannot be copied, scanned, reproduced, or used for presentations without written permission and payment for usage. They cannot be utilized or replicated in any manner, such as displaying on broadcast screens or posting on websites, without proper authorization.
3. Users must not use images in a manner that defames, is obscene, or contains explicit content.
4. Users must not integrate images into logos, trademarks, or service marks.
5. Users must exercise caution to avoid violating the restrictions provided during the service before using the images. </aside>

1. Attribution provided by the company must be included either alongside the images or in the form of watermarked service images.
2. In the event of a violation of the attribution requirement, the user will be liable to pay a fee three times the usage fee specified in the contract. </aside>

<aside> <img src="/icons/clipping_gray.svg" alt="/icons/clipping_gray.svg" width="40px" /> Pre-Consent for Incomplete Metadata

1. The metadata for the data provided by the company may contain academic or factual errors in its content. Metadata includes technical information, descriptions, data titles, related individuals, trademarks, sources, dates, producers, copyright information, and more related to the data. The company makes reasonable efforts in the private domain to verify caption information for individual data, but it does not assume responsibility for incorrect or incomplete metadata information.
2. You may request corrections for metadata errors from the company. </aside>

<aside> <img src="/icons/clipping_gray.svg" alt="/icons/clipping_gray.svg" width="40px" /> Cancellation and Termination

1. The company reserves the right to revoke this agreement at any time without prior notice if the user or the user's client fails to comply with any provision of this contract. Upon termination of the agreement, the user must immediately cease the use of images, delete images and all copies from their devices, and destroy all other copies. </aside>

<aside> <img src="/icons/clipping_gray.svg" alt="/icons/clipping_gray.svg" width="40px" /> Electronic Storage

1. For all data received in electronic format, the user must include all metadata or other identifying numbers related to the images as part of the electronic file. The user must take all reasonable measures to protect the data from unauthorized access by third parties.
2. High-resolution images must be used and paid for in accordance with the contract and usage permissions provided by the company. For security reasons, the user may retain one backup copy of the high-resolution images. Unused backup copies of all high-resolution images may only be maintained and stored in a maximum resolution of up to 600 pixels on the longest side. All original files must be disposed of immediately upon data use. </aside>

1. After paying the usage fee, you can receive and use Modern Times data.
2. If a user, after receiving usage permission, decides to withdraw their decision, a cancellation fee of 50,000 KRW will be applied per individual image if the cancellation is made within 14 days. For all withdrawal requests made within 30 days, a cancellation fee equivalent to 50% of the amount paid will be applied. After canceling usage, the rights to use the images will be revoked, and the user must immediately delete the data received from Modern Times. </aside>

<aside> <img src="/icons/clipping_gray.svg" alt="/icons/clipping_gray.svg" width="40px" /> Guarantees and Disclaimers

1. The company has the direct or transferred rights to use the data provided by Modern Times as the contracting and executing party in this agreement.
2. The company does not provide any warranties, whether explicit or implied, regarding the data provided by Modern Times. This includes warranties of suitability for specific purposes, merchantability, or academic value. The company does not assume responsibility for general, punitive, special, indirect, consequential, or incidental damages, or lost profits or any other damages, costs, or losses, whether incurred by data users, third parties, or organizations, even if the company has been advised of the possibility of such damages, costs, or losses.
3. The maximum liability for any damage, cost, or loss arising from the use of images by the company, whether due to contract, tort, or otherwise, is limited to the value of the service fees paid by the user for the images.
4. The representations and warranties provided by the company in this agreement apply only to the data provided by the company and are void if the user uses the data in a manner not explicitly approved by this agreement or if the user violates this agreement. </aside>

1. This agreement constitutes the entire agreement. It represents the complete agreement between the user and the company and supersedes any prior or contemporaneous agreements. The user may not unilaterally withdraw or modify any provision of this agreement, and any such modification or waiver shall be effective only in writing and shall apply only to the provision or conditions specified therein.
2. The user is considered to have agreed to this agreement only after reading and understanding its provisions. If the user does not agree to the provisions of this agreement, the user should not use the service. By agreeing to this agreement, the user enters into a legal contract with the company. </aside>

Purpose of Processing Personal Information

The processed personal information will not be used for purposes other than those listed below, and if the purpose of use changes, necessary measures will be taken in accordance with Article 18 of the Personal Information Protection Act to obtain separate consent.

1. Data usage, website membership registration, and management: We process personal information for the purpose of verifying the intention of membership registration, authenticating and identifying members, maintaining membership qualifications, preventing misuse of services, notifying various notices, handling complaints, and more.
2. Complaint handling: We process personal information for the purpose of handling complaints, such as personal information access, correction/deletion of personal information, requests to stop processing personal information, reporting personal information leakage incidents, and reporting personal information breaches.
3. Mailing services for Modern Times events and promotions: We process personal information for the purpose of providing mailing services related to Modern Times events and promotions. </aside>
